In the past, United States Citizens filing expatriate tax
returns have not been audited by the Internal Revenue Service that often.
However, this has now changed. Expatriates tax returns for past years are now
being audited. You may have already or will soon receive a notice of audit.
Do not represent yourself unless you are an expert on US expatriate and
international tax law and even then experienced audit counsel may save you
significant additional tax adjustments and penalties.
We
recently acquired copies of the questionnaires used by the IRS to conduct
audits of Form 2555 which is filed to claim the foreign earned income
exclusion. Such audits are usually conducted by mail and the IRS agent
makes their audit decisions based on the documents, and answers supplied to
the Agent by the taxpayer being audited.
The following forms are used by the IRS to
audit expatriates claiming the foreign earned income exclusion.
